These Terms & Conditions ("Terms") govern your access to and use of the ClaimPulse Ai service (the "Service"), provided by ClaimPulse Ai ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

1. The Service

ClaimPulse Ai is a software service that helps physical therapy clinics draft insurance appeal letters using automated generation tools. The Service produces draft documents intended for review, editing, and submission by qualified clinical and billing staff.

2. Acceptance

By continuing to use the Service you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization. You must be of legal age to enter into a binding contract.

3. Account & Credentials

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information and keep it updated.

4. Acceptable Use

You agree not to misuse the Service. In particular, you must not:

  • Use the Service for any unlawful, fraudulent, or deceptive purpose;
  • Submit content you do not have the right to submit, or content that infringes any third party's intellectual property or privacy rights;
  • Send spam, malware, or attempt to interfere with, probe, scan, or scrape the Service or its infrastructure;
  • Reverse engineer, resell, or redistribute the Service, or attempt to circumvent technical limits;
  • Use the Service to generate content that is illegal, harassing, hateful, or intentionally misleading to an insurer or regulator.

5. Clinical Responsibility

Output from the Service is a draft, not clinical or legal advice. You are solely responsible for reviewing every generated document for accuracy, verifying clinical facts, and ensuring compliance with applicable law, payer rules, and professional standards before submitting to any insurer.

6. Intellectual Property

We retain ownership of the Service and all associated software, documentation, and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your subscription plan. You retain ownership of the content you input and the generated drafts you produce.

7. User Content

You grant us a limited license to host and process the content you submit solely to provide and improve the Service. You are responsible for ensuring you have the necessary rights and patient authorizations to submit any protected health information.

8. Payment, Subscription, and Refunds

The Service is offered on a recurring monthly subscription. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by the Paddle Buyer Terms. 9. Service Level

We work to keep the Service available and reliable but do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

10. Suspension & Termination

We may suspend or terminate your access for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. You may cancel your subscription at any time via the customer portal or by contacting us.

11. Limitation of Liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid us in the twelve months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury where such exclusion is prohibited by law.

12. Indemnity

You agree to indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

13. Changes

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which ClaimPulse Ai is established, without regard to conflict-of-laws principles.
